Elliott Industries Pty Ltd trading as Elliott Motorcycles ACN 618 593 598 (referred to in this document as we, us or our) is committed to providing you with products that are what we say they are, do what they are designed to do, and ultimately make you look good. We spend a lot of time developing and refining our products for your enjoyment. We recognise though, that sometimes a product may not be what you expected it to be. Should this happen, we invite you to review the following terms concerning product returns.
The rights described in this policy are in addition to the statutory rights to which you may be entitled under the Australian Consumer Law and other applicable Australian consumer protection laws and regulations. Please note there may be limitations on your right to return and obtain a refund for products under this policy. However, these limits will always be subject to your statutory rights and our policy does not exclude or replace your rights under the Australian Consumer Law. We reserve the right to amend this policy from time to time. Amendments will be effective immediately upon notification on our store. Your continued use of our store following such notification will represent an agreement by you to be bound by the policy as amended.
We use the term “product” or “products” to refer to goods and services offered in our online store.
Products Which are Ineligible for Return
Some items are not eligible for change of mind return. Please choose carefully when purchasing the following as change of mind returns will not be provided on:
- Products that have been personalised or customised
- Special order products, if not part of our online store offering
- Clearance items or those marked with a designation such as “Sale”
- Services that have been performed or consumed
- Products purchased from other entities or resellers
Please note: all change of mind returns relating to purchases from other entities or resellers must be directed to the entity or reseller. We do not guarantee that a reseller will accept returns, nor do we guarantee that their returns policy will be equivalent to our returns policy. You should obtain, read and understand the reseller’s returns policy prior to ordering or purchasing any goods.
Eligible Products which May be Returned
We will accept change of mind returns and exchanges for eligible products for 14 days from the date you receive the product. In assessing the eligibility of your return, we may at any time request evidence of the actual delivery date from you and/or relevant mail services, couriers, or other delivery service providers.
A product must be in like new condition and in its original packaging, along with all parts, components, instruction manuals and documentation that comprise the entire product as delivered to you in order to be eligible for a change of mind return.
A valid purchase receipt must be provided to us along with the returned product/s.
All returns must be notified to Community and Customer Support via firstname.lastname@example.org before we receive the returned product in order for the returned product to be assessed as being eligible for a change of mind return. We will respond to your return request as soon as possible after having received your email and/or returned product/s should we determine that a return is ineligible, or should there be a need to contact you in order to process an eligible return.
When you make an eligible change of mind return, we will credit the full amount, less the original shipping and handling charges (if any), additional bank fees charged by your financial institution and/or payment provider including (but not limited to) international transaction fees (if any), foreign currency conversion fees (if any), and any import duties if applicable in your country.
You will typically receive your refund in approximately 3-5 business days of us having received the returned product/s. It can take several days for your financial institution or payment provider to process a refund. If it is taking longer than expected, contact your financial institution or payment provider first. If you’re still experiencing problems, please then contact Community and Customer Support via email@example.com.
You may receive a change of mind refund in one of the following ways:
- Electronic funds transfer
- Store credit
We will only remit refunds via electronic funds transfer to a bank account where the name of the bank account holder matches the payer’s name/information as provided to us at the time of purchase.
In some circumstances we may not be able to remit refunds via electronic funds transfer. Reasons for this may include (but are not limited to) your financial institution not being recognised by our bank. By ordering and/or purchasing an Elliott Motorcycles product you acknowledge and agree that in these circumstances a change of mind refund will be provided via store credit.
